TERMS AND CONDITIONS OF AUTHORIZED AGREEMENT
1. SCOPE OF WORK
These Terms and Conditions govern all service, repair, and installation work performed by Long Glazing & Doors, Inc. (“Contractor”) for residential and commercial customers (“Client”) in the State of California. Services may include troubleshooting, replacement of parts, new installation of doors/windows, and related hardware or accessories.
All work will be performed as detailed in the Authorized Work Order, Proposal, or Estimate approved by the Client in writing.
2. AUTHORIZATION TO PROCEED
By signing the service authorization or accepting a formal estimate, the Client grants Long Glazing & Doors permission to enter the project site and perform the agreed-upon work. The person authorizing service affirms they have legal authority to approve work at the listed property.
3. PAYMENT TERMS
• Service Calls: Minimum service charges apply and will be disclosed prior to scheduling.
• Invoices: All invoices are due upon receipt unless otherwise stated in writing.
• Late Fees: A 1.5% monthly interest (18% per annum) may apply to all overdue balances.
• Deposits: A deposit may be required before work begins for custom or special-order materials, as well as service repair calls.
• Payment Methods: We accept checks, credit cards, and financing. Returned checks are subject to a $35 fee.
4. CANCELLATION / ACCESS
• Appointments canceled with less than 24-hour notice may incur a service fee.
• Inaccessible job sites upon arrival may result in trip charges or rescheduling.
• Client is responsible for providing safe and legal access to all areas requiring work.
5. MATERIALS AND WARRANTIES
• New Installations: All manufacturer warranties apply to installed materials and products. Warranty periods vary by product. Long Glazing & Doors does not warrant materials beyond the manufacturer’s stated coverage.
• Labor Warranty: Labor for new installations is warranted for one (1) year from the executed contract agreement date.
• Service Repairs: Labor on repair service is not guaranteed unless specifically reviewed and stated in writing.
6. LIMITATIONS & EXCLUSIONS
This agreement does not cover:
• Hidden or unforeseen conditions
• Pre-existing damage or non-code-compliant work
• Damage from misuse, abuse, neglect, vandalism, acts of God, or unauthorized repairs
• Structural or electrical work outside the scope of door/window systems
If such conditions are encountered, a revised estimate or change order may be required.
7. PERMITS & CODE COMPLIANCE
Client is responsible for obtaining any permits unless otherwise stated in writing. Long Glazing & Doors will perform work to meet applicable California building codes but is not responsible for prior noncompliant work unless contracted to correct it.
8. LIMITATION OF LIABILITY
To the fullest extent allowed by California law, Contractor’s liability is limited to the total value of the contract. Contractor shall not be liable for indirect, incidental, special, or consequential damages including lost revenue, property damage outside the immediate scope of work, or business interruption.
9. INSURANCE & SAFETY
Contractor is licensed and insured in the State of California. Clients are required to maintain adequate property and liability insurance. Worksite must be free of unsafe conditions prior to commencement of services.
10. DISPUTES AND GOVERNING LAW
Any dispute arising under this agreement shall be governed by the laws of the State of California. Jurisdiction shall lie exclusively in the courts of San Diego County, California. In the event of a dispute, both parties agree to attempt resolution through mediation before pursuing legal action.
11. ENTIRE AGREEMENT
These Terms and Conditions, along with the signed proposal or work order, constitute the full and complete agreement between the parties. No verbal modifications will be binding unless agreed to in writing by both parties.
